1 Regulations Payment with order by credit card or check
2 Acceptance of the general conditions of sale. All orders are subject to the unreserved acceptance of the general conditions of sale.
3 Dispute and jurisdiction clause For all disputes relating to sales made by the company Au Coeur 2 SAS and the application or interpretation of these General Conditions of Sale, only the Commercial Court of Saint Dié des Vosges (88100) will be competent.
4 Cases of Force Majeure Au Coeur 2 is not responsible in particular in the event of fire, floods, interruption of the supply of energy, raw materials or spare parts, as well as total or partial strikes of any kind hindering the smooth running of the society, such as strikes in transport, postal services. The occurrence of a case of force majeure has the effect of suspending the performance of the contractual obligations of the company Au Coeur 2
5 Retention of title clause Au Coeur 2 expressly reserves ownership of the goods delivered and designated below until full payment of their price in principal and interest. The goods will remain the property of the seller until full payment of their price, but the buyer will become responsible for them as soon as they are physically handed over, the transfer of possession entailing that of the risks. The buyer therefore undertakes to take out, upon acceptance of this document, an insurance contract guaranteeing the risks of loss, theft or destruction of the designated goods, if the value of the goods requires such a contract.
6 Delivery time Delivery times are given for information only and without guarantee. A delay does not authorize the buyer to cancel the sale, to refuse the goods or to benefit from damages. In the event of partial delivery, the balance of the delivery is made free of shipping costs as quickly as possible.
7 Lack of conformity of the goods The goods travel at the risk of the customer, who is responsible for checking that they are in good condition at the time of delivery. This verification must relate to the quality, quantities and references of the goods as well as their conformity with the order. No complaint will be taken into account after a period of fifteen days from the day of delivery. Merchandise with a recognized lack of conformity, reported within the above-mentioned period, is subject to replacement or restoration, excluding any compensation, for any reason whatsoever. In case of impossibility of replacement (goods at the end of their life or prolonged out of stock) the refund of the article will be made.
